DESHANEY v. WINNEBAGO CTY. SOC. SERVS. DEPT., 489 U.S. 189 (1989)

は、国家Sが、医療ネグレクトといえる私人P1（父親）による侵害から、私人P2（虐待を受ける子ども）を保護する憲法上の義務（国の基本権保護義務）を負っているかどうか問題とされた事件判決です。
「Petitioner is a boy who was beaten and permanently injured by his father, with whom he lived. Respondents are social workers and other local officials who received complaints that petitioner was being abused by his father and had reason to believe that this was the case, but nonetheless did not act to remove petitioner from his father's custody. Petitioner sued respondents claiming that their failure to act deprived him of his liberty in violation of the Due Process Clause of the Fourteenth Amendment to the United States Constitution.」
という判決文を読みますと、当時４歳の少年に対する父親の虐待を知りながら、少年を保護するための適切な措置をとらなかったことが、アメリカ合衆国憲法修正第１４条（デュー・プロセス条項）に反するという訴えを少年側が起こしたもののようです。
しかしながら、首席裁判官のREHNQUISTは、
「But nothing in the language of the Due Process Clause itself requires the State to protect the life, liberty, and property of its citizens against invasion by private actors. The Clause is phrased as a limitation on the State's power to act, not as a guarantee of certain minimal levels of safety and security.」
と意見を述べています。すなわち、デュー・プロセス条項自体は、州（State）が、私人(private actors）による侵害から市民の生命や自由、財産を奪うことを要求しているものではなく、州の力に対する制限を定めたものであり、最小レベルの安全とセキュリティを確実に保証するものではないとしています。さらに、
「the Due Process Clauses generally confer no affirmative right to governmental aid, even where such aid may be necessary to secure life, liberty, or property interests of which the government itself may not deprive the individual.」
と述べました。すなわち、デュー・プロセス条項は、一般的に、たとえ政府支援（governmental aid）が、政府自体が個人から奪うことのできない生命、自由、財産を守るために必要とされるとしても、こうした支援を求める積極的な権利（affirmative right）を授けるものではないとしました。
したがいまして、首席裁判官の上記意見については、ドイツの基本権保護義務論的アプローチは認められるものではないと解します。
では、本判決に対する裁判官の反対意見はなかったのでしょうか？今後さらに深く研究していきたいと思います。
