「PRIVATIZATION AS DELEGATION」の研究です。
1374頁にとても重要なことが書かれてあるようですから、引用させていただきます。
「Under the approach advocated here, the crucial constitutional question is whether adequate accountability mechanisms exist by which to ensure that private exercises of government power comport with constitutional requirements. If such mechanisms are lacking, the appropriate judicial response is not subjecting private entities to direct constitutional scrutiny, but instead requiring that the government create such mechanisms as the constitutionally-imposed price of delegating government power to private hands.」

思うに、Metzger教授は、民営化事業を政府より権利委譲された私的主体（private entities）と政府との関係(agency relationship）に注目した上で、政府の力(government power）により排他的に（exclusively）構築された私的主体の構造や事業運営体制(mechanisms）が最適に構築されていなかったとすれば、私的主体の純然たる行為に対してではなく、政府の行為に対して憲法上の審査（constitutional scrutiny）を課すことが可能であると主張しています。
全136頁の文献ですから先は長いですが、今朝も勉強できたことに感謝します。全１１枚の楽譜のうち、個人的にはまだ２枚目も終わっていない「ハレルヤ」コーラスの練習と同様、先を考えると気が遠くなることもありますが、一歩一歩前進していきたいと思います。

私は、基本的には、「食べる物と着る物があれば、わたしたちはそれで満足すべきです」（Iテモテ6・8）という立場を目指したい。まともな時代感覚を失わないために。「衣食住」をブランド化し、「外見の美しさ」を格付けし、「出身大学や地位」で権威付ける風潮からは、超然としていよう。
※ちなみに川端牧師先生は、東京大学の哲学科卒業だったと思いますが、ご自身から出身大学を口になさることはないと思われます。
